RUSTENBURG HERALD - MOGWASE - The Mogwase Regional Court recently sentenced six men to direct imprisonment for their roles in the murder and kidnapping of 34-year-old Katlego Donald Tshite.
The accused, Sydney Obakeng Raikane (40), Happy Magatshe (34), Karabo Edward Modise (32), Matshidiso Motshepe (34), Kamogele Eric Mosothoane (34), and Sikwane Dunga Danke (40), received sentences ranging from 10 to 20 years' imprisonment.
The charges stem from a tragic incident on 31 January 2023 in Manamakgoteng village, Rustenburg. Investigations revealed that Tshite, who had been attending a bereaved family's gathering, was accused of stealing a hair clipper. Despite his protestations of innocence, community members apprehended him. When Tshite attempted to flee, he was captured and taken to a nearby "Apollo light," a location infamously used for extrajudicial "community trials."
At this site, Tshite was subjected to a brutal assault that resulted in his death. His body was discovered the following day. The hair clipper, the alleged cause of the altercation, was later found within the family’s possession, though details of its recovery remain unclear. All six accused pleaded not guilty to charges of murder and kidnapping. However, evidence presented linked them to the crime, and they were convicted.
In arguing for harsh sentences, State Prosecutor Tebogo Mokoka emphasised the need to deter vigilantism and promote respect for the rule of law. She highlighted the irreplaceable loss of life caused by the accused's actions and urged the court to impose life imprisonment.
The presiding Magistrate, Lebo Raborife, concurred with the state’s call for accountability but ruled out life imprisonment, citing considerations from pre-sentence reports. She emphasised that the sentences should reflect the degree of each accused’s involvement in the crime.
Sentences imposed are as follows: Karabo Edward Modise - 20 years' imprisonment, Matshidiso Motshepe - 20 years' imprisonment, Sydney Obakeng Raikane - 10 years' imprisonment, Happy Magatshe - 10 years' imprisonment, Kamogelo Eric Mosothoane - 10 years' imprisonment and Sikwane Dunga Danke - 10 years' imprisonment.
Director of Public Prosecutions in the North West, Dr Rachel Makhari, welcomed the sentences and praised the collaborative efforts of law enforcement and prosecution teams. "The NPA stands firm in ensuring that justice is served. Acts of violence and vigilantism have no place in our society. Communities are urged to report crimes to the authorities and allow the legal system to take its course," said Dr Makhari.
